Citizen Request DetailCitizen Request StatusIDCR-280 Submitted 08/18/10 Status Completed 08/24/10 Department Planning Department Subject City Sign Ordiance Description It was reported on a local TV station that City Council member Sharon Parry has publicly pointed out that Gagner (the owner of the bus bench company) is not complying with the Idaho Falls sign Ordinance Code, because the benches have advertisements on them, and that is prohibited. Apparently the Mayor and City Council have come up with an approach to allow some benches to remain with advertisements. Is the City code going to be changed to reflect this special deal? If not, I would be concerned that the City would be open to severe law suits. Selective enforcement of City Code by elected Officials is inappropriate (and perhaps illegal). Notes Section 8-8-21 of the City Code, a portion of the bus bench ordinance, authorizes advertising on the bus benches. The bus bench ordinance was passed in 1988. The sign ordinance which permits off-premise advertising in some but not all locations in Idaho Falls was passed in 1984. When the Council passed the bus bench ordinance, the provision of that ordinance which allowed advertising on bus benches overruled the general sign ordinance and advertising is specifically allowed on bus benches.
